Alcohol Found in Everday Items and Why That Could Matter

People generally attach to numbers when they hear them.  For example, Julia Roberts makes $20 million dollars per film.  No one considers how much she actually puts in her pocket after taxes, agent fees, paying a publicist, etc.  Without the exact numbers, she probably pockets 8 to 9 million dollars per film which is a far cry from twenty million.

On a more relevant front, alcohol readings on a breath machine or other devices used by law enforcement tend to be accepted as fact.  This crucial mistake is often made even by attorneys that don’t regularly handle DUI work.  There are so many reasons these BAC readings can be, and often are, inaccurate.  Now that matters to someone who is arrested for DUI unlike how much Julia Roberts makes.

For example, the ABA Journal reported a Florida court ordered teenager who has been charged with DUI manslaughter to wear an alcohol monitor.  The monitor sent an alert and claimed she had a BAC of more than .02.  The prosecution sought to have her bond revoked and keep her in jail until her trial.  However, after a hearing the judge determined the monitor was set off by the hairspray the defendant used.  Several affidavits were offered which stated the teenager was not drinking.  Of course, the owner of the manufacturing company of the monitor said this could happen, but his product did not produce a false positive.  Luckily for this teenager she had quality lawyers who challenged the notion that the monitor must have been accurate or she could have been sitting in jail for months awaiting trial.
